Legal obligation
- At the earliest from 12 August 2028 (the later date applies, 24 months after the entry into force of the implementing acts under Art. 12(6) or (7)) packaging placed on the market bears a harmonised, pictogram-based marking of the material composition that helps consumers to sort. Packaging containing substances of concern is marked using standardised and open digital marking technologies (Art. 12(1)).
- The markings under Art. 12(1), (2) and (4) and the data carriers are placed on the packaging in a clearly visible, clearly legible and indelible manner so that they cannot be easily removed; the information is also available to end users before purchase in online sales. This applies at the earliest from 12 August 2028 (para. 1) or 12 February 2029 (para. 2) (Art. 12(5)).
- At the earliest from 12 February 2029 (the later date applies, 30 months after the entry into force of the implementing act under Art. 12(6)) reusable packaging placed on the market bears a marking informing about its reusability. Further information is made available through a QR code or another standardised and open digital data carrier (Art. 12(2)).
- Where the information under Art. 12(1), (2) and (4) is provided by electronic means, personal data are collected only to the extent needed to give access to the conformity information, and the information is not displayed together with sales or marketing information. This applies at the earliest from 12 August 2028 (para. 1) or 12 February 2029 (para. 2) (Art. 12(5)).
